TERMS & CONDITIONS

  1. The Gary's Great Trips Promotion 2009 (the "Promotion") is open to all UK and Republic of Ireland residents over 18 except employees of Walkers Snacks Limited (the "Promoter"), its affiliated companies, their agents or other companies professionally connected with the Promotion, and the immediate families of those employees.
  2. By taking part in this Promotion all participants will be deemed to have accepted and be bound by these terms and conditions.
  3. Find your unique code (worth a number of points) within promotional packs of Walkers Crisps Multipacks and on the outside of Standard (34.5g and 50g), and Max single packs. Each code can only be used once. Only codes from Gary's Great Trips 2009 promotional packs will be accepted. Codes must come from promotional packs showing a closing date of 31st December 2009.
  4. Set up your account at www.walkers.co.uk (the "Website") and start collecting points in exchange for codes. Participants may only register one account and one mobile number.
  5. Codes can be collected from 7 May 2009 and redeemed from 12 May 2009 until 31 December 2009.
  6. The Website will be open from 7 May 2009 and will close on 31 December 2009.
  7. You can set up you account and start banking points from 7 May 2009.
  8. Points can be redeemed against a Trip or Offer or used to bid to win a VIP Trip. Points can be banked in your account to allow you to save up for Trips or Offers or to bid in a VIP Trip auction.
  9. The required points value for each Trip or Offer will vary. Details of points required for a particular Trip or Offer can be found on the Website.
  10. Points will be deducted from your account when you book a Trip or make a bid. Once points have been deducted from your account it is not possible to provide a refund. It is your responsibility to check availability of your Trip (e.g accommodation availability) or specific requirements (e.g. age or height restrictions) on the Website before you confirm the Trip or make a bid.
  11. Every point can be converted into the equivalent of a £1, or €1 in the Republic of Ireland, saving against Trips or Offers.
  12. The savings indicated next to each Trip on the Website which relates to a stay at a hotel or B&B is based on lowest rate available at that venue (in most but not all instances this is on double occupancy), based on prices at time of publication.
  13. The savings indicated next to each Trip on the Website which relates to a stay at an apartment, house or self-catering venue is based on lowest per night rate available at that venue on a pro rata basis of the normal price structure based on prices at time of publication.
  14. The savings indicated next to each Trip on the Website which related to a stay at a hostel or backpacker accommodation is based on lowest rate available at that venue per person per night based on prices at time of publication.
  15. The savings indicated next to each Trip deemed as an "attraction" on the website is based on the full adult price which may include gift aid.
  16. The savings indicated for half price theatre tickets are based on the two highest seat prices for that show.
  17. Codes may be submitted by sending a text to 51199. You will receive a confirmation text and your points will be credited to your account within 24 hours. All texts to 51199 during the period of the promotion will be provided free of charge across all networks courtesy of O2. By texting your code you consent to receiving a marketing message from Walkers and O2. If you do not wish to receive marketing messages by text you may submit codes on the Website.
  18. Collect Points to receive Trips and Offers

  19. Details of the Trips and Offers, offered by the Promoter's partners (the "Promotional Partners"), the number of points required and how to redeem them are available on the Website. For a summary of the Offers and the number of points required click here.
  20. When you have collected enough points for your chosen Trip/Offer, submit your points and follow the corresponding redemption instructions. Please note specific terms and conditions including restrictions, standard opening and closing times apply to each Trip/Offer and full details of each Promotional Partner's terms and conditions are available on the Website and form part of these terms and conditions.
  21. Please check the Website carefully for the Promotional Partners' booking deadlines as individual Trip/Offer closing dates vary.
  22. Some Trips/Offers must be booked in advance and are subject to availability. Promotional Partners have the right to charge the full price if a Booking Reference has not been used to pre-book the Trip/Offer or if the Booking Reference is not presented upon arrival. Participants using a Booking Reference who fail to attend a pre-booked venue will automatically lose all rights to the Trip/Offer.
  23. You can transfer the points you have gained from collecting codes from Walkers crisp packets to someone else's account.
  24. Collect Points to bid for VIP Trips

  25. Details of the VIP Trips and how to make a bid are available on the Website.
  26. Two points will be deducted from your account for each bid in an auction for a VIP Trip.
  27. You may make as many bids as you wish for a VIP Trip according to the number of points you have banked.
  28. The winner of a VIP Trip auction will be the participant who correctly identifies and bids the lowest unique value in whole numbers. You will be required to exercise your skill and judgement in assessing which is likely to be the lowest unique value in whole numbers. The lowest possible unique bid is 1 and there is no maximum bid number. Bids may be in whole numbers only and bids featuring pence or decimal numbers will not be valid.
  29. If you submit a bid which is not unique, or which is not the lowest bid you will receive a message from the Promoter informing you of the status of your bid. You will the have the opportunity to reassess your bidding strategy and to bid again in exchange for two points, unless the auction has already closed.
  30. There will be auctions occurring on the Website from 12 May to 9 August 2009. The number of auctions per day and each auction's duration may vary and details should be checked on the Website.
  31. Before you make your bid refer to the details of each VIP Trip on the Website for any specific restrictions and terms and conditions which will form part of these terms and conditions.
  32. The winner of each auction will be notified by email within seven days of auction close. This email will advise Winners how to redeem their VIP Trip. Each auction page on the website displays a countdown giving details of remaining time available to bid for a specific VIP Trip.
  33. Auction winners may be asked for proof of their age.
  34. General

  35. Walkers Promotional Partners include: Merlin Entertainments (Alton Towers, Madame Tussauds, London Eye, Thorpe Park, The Dungeons, Legoland, Chessington World of Adventures, Sea Life Centres & Warwick Castle), National Trust, IHG (Intercontinental Hotels Group), Enjoy England, Visit Wales, Northern Ireland Tourist Board, RSPB, City Sightseeing, Dewynters and British Horseracing Authority).
  36. The Booking Reference and VIP Trips are non-transferable, non refundable and cannot be exchanged for any cash alternatives in whole or in part. The promoter accepts no liability for lost or stolen Booking References. On the closing date of this promotion, you will forfeit your remaining points. The decisions of the Promoter are final and no correspondence will be entered into.
  37. Attempts to enter the same code more than once, or the use of promotional codes not intended for use in this promotion, will result in the relevant account being frozen for 48 hours. Repeated frozen accounts will be seen as fraudulent attempts to hack into the Website or undermine the promotional integrity and will be investigated. The Promoter may freeze your account pending or during the investigation, and your account may be deleted if we are concerned for the Website's security and the integrity of the promotion. The Promoter's decision to freeze and/or delete any account is final. If your account has been deleted, you will forfeit the use of the codes or points in it, will not be able to re-open it and will not therefore be able to participate in the promotion any further.
  38. Codes can only be used on-line via the Website, via the WAP site, or via SMS for use during the Gary's Great Trips promotion. Codes have no cash value and cannot be exchanged for cash. The selling of codes, packaging or Gary's Great Trips accounts is strictly forbidden. The Promoter may require reasonable proof of purchase from Registered Users in the UK and the Republic of Ireland.
  39. Participants may be required to take part in related publicity. VIP Trip winners may have their name and county displayed on the Website.
  40. Personal data about you will be processed in accordance with our Data Use Policy and Privacy Statement. We will not disclose your data to any third party organisation without your explicit consent.
  41. The sole exception to this would be where the data may be provided to a third party company, such as a mailing house or web agency, for the sole purpose of delivering a service to you on our behalf for example in the instance of our Golf partner for the purpose of delivering the voucher.

  43. The WAP site will be a scaled down version of the website which allows participants to bid for VIP Trips and redeem points against Trips and Offers.
  44. You will be charged for WAP access at your service provider's rate for using their WAP service. Please check with your service provider for details of these charges.
  45. For names and countries of VIP Trip winners send a Self Addressed Envelope to: Walkers, Gary's Great Trips, c/o The Big Kick, The Old Station House, Orient Close, London Road, St Albans, Herts, AL1 1JD by 31 January 2010.
  46. Limitation of Liability

  47. As of the start of the promotion all Trips and Offers have been confidently based on a 1 point = £1 saving calculation, or 1 point = €1 calculation in the Republic of Ireland. In the event that the Trips and Offers or the value of points change through the promotion, we will update Website and Trips and Offers. In the event that you redeem a Trip or Offer and do not receive the 1 point = £1 or in the Republic of Ireland 1 point = €1 saving, we will reimburse the points to your account.
  48. All details relating to the Trips and Offers, whether obtained by point redemption or by a winning bid are correct at the start of the promotion but may be subject to change, and as such the Promoter reserves the right to withdraw, amend or replace a Trip or Offer without prior notification throughout the promotion due to unforeseen circumstances or to circumstances outside of the Promoter's control.
  49. Individuals taking part in any of the Promoter's Partners' Trips or Offers contract directly with the Promotional Partner and/or venue and as such take part in activities at their own risk and the Promoter accepts no liability with regard to such activities whatsoever.
  50. The Promoter and/or Promotional Partners will not be responsible for codes, bids or text entries not received, recognised or delayed. Proof of sending or entering such details does not constitute receipt. The Promoter and/or Promotional Partners will not be liable for a person missing a bid due to system failures, network error, site down-time, hacks on the system, personal computer, or mobile phone handset or network malfunction.
  51. The Promoter and/or Promotional Partners will not be responsible if participants do not receive the item they have won in auctions if they have supplied insufficient, incorrect or false information when registering on the Website.
  52. The Promoter and/or Promotional Partners will not be liable for any delayed or non-delivery of emails to participants. It is the responsibility of the registered user to check that emails from the Promoter or its Promotional Partners will not be automatically classed as "junk" or "spam" and sent to the user's junk mail filter or otherwise filtered or deleted.
  53. The Promoter cannot accept responsibility for any technical or other problems that mean participation is impossible or delayed, or bids, claims or entries are not accepted for any reason whatsoever.
  54. The Promoter and/or Promotional Partners do not guarantee continuous, uninterrupted or secure access to the Website. Numerous factors outside of the control of the Promoter and/or Promotional Partners may interfere with the operation of the Website. To the extent permissible by law the Promoter and/or Promotional Partners exclude all implied warranties, conditions and other implied terms.
  55. If, for any reason, this Promotion is not capable of running as planned the Promoter reserves the right to cancel, terminate, modify or suspend all or part of it. This includes but is not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Promoter.
  56. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of or unauthorized access to, or alteration of, or non-receipt of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter or an entrant because of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to any participant's or any other person's computer related to or resulting from participation or downloading any materials in this Promotion.
  57. Infringement of Terms and Conditions

  58. The Promoter reserves the right in its sole discretion to disqualify any person who corrupts or affects the administration security, fairness, integrity, or proper conduct of this Promotion, who tampers with the entry process, or may benefit from such tampering. The Promoter reserves the right to suspend individuals, freeze and/or delete any individual's accounts, where the individual is suspected of interfering with any bidding information. This includes but is not limited to the use of software to place automated bids in VIP Trip auctions and use of software to place winning VIP Trip bids, generate false accounts, guess or generate codes. If such activity is suspected the Promoter will delete the offending accounts, all accrued points and rewards obtained will be forefeited.
  59. Any attempt to deliberately damage the Website or the information on it, or to otherwise undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
  60. Attempting to gain access to someone else's Gary's Great Trip's account and/or account information, or trying to obtain, generate, or guess another users account information is strictly forbidden and should any participant attempt to do this, their account will be deleted and they will be permanently banned from the Website. If this happens, the offending participant will forfeit all points in his/her account and will not be permitted to participate in the Promotion any further. The Promoter may decide to take further action.
  61. Participants must not register or use the Website on behalf of another individual without that individual's express permission.
  62. Gary's Great Trip's accounts cannot under any circumstances be sold, combined or merged with another Gary's Great Trip's account.
  63. The Promoter reserves the right to terminate the account of any person who it reasonably suspects has violated or infringed any of these general terms and conditions.
  64. The Promotion and these terms and conditions shall be governed by the laws of England and Wales. By participating in the Promotion you agree to submit to the exclusive jurisdiction of the courts of England.
  65. Headings in these general terms and conditions are for convenience only and are not to be taken into account in the interpretation of any of the terms set out in these terms and conditions.
